The laws surrounding dog attacks and dog bite injuries can vary from state to state. As a dog bite victim, it is important to know your rights as well as how the laws can protect you.
In Nevada, there is no liability statute for an average dog bite. The common law for liability, however, states that if the plaintiff can prove that the dog owner's negligence lead to the dog bite injury, the plaintiff may recover damages for the dog bite injury.
If a dog is involved in a dog bite incident, the animal may be characterized by one of the following categories.
- Dangerous - If, on two separate occasions within an 18-month period, the dog acts menacingly to a degree that a reasonable person would feel the need to defend himself, whenever the dog is off the owner's premises and/or not confined in a cage, pen or vehicle.
- Vicious - If, without provocation, the dog kills or inflicts serious bodily harm to a person. Also, if the owner is notified of the dog's "dangerous" status and the dog continues to act menacingly to a degree that a reasonable person would feel the need to defend himself, whenever the dog is off the owner's property and/or not confined in a cage, pen or vehicle.
Nevada law states that it is illegal for a person to own a "vicious" dog. If a dog is considered "dangerous," the owner must provide proper training and socialization for the dog to prevent future attacks. By disregarding this law and allowing the dog become "vicious," the owner is putting other people in harm's way and can be found liable for injuries and death that may result.
In addition to these laws, there is a statute of limitation of two years for dog bite incidents in Nevada. It is imperative that you seek the advice of an experienced dog bite lawyer immediately following a dog attack. Laws surrounding dog bite incidents are complex. By hiring a reputable law firm to handle your case, you will be able to protect your rights and seek financial compensation for your losses.
